Managing disciplinary processes strikes dread into most employer’s hearts. Easy to get wrong, and potentially stressful for all parties, matters need managing confidently, sensitively and fairly. An understanding of the principles, and key skills are a prerequisite for managing the disciplinary process.

This Face-to-Face event will provide you with the key skills you need to confidently manage disciplinary procedures in your workplace and remotely.

This is a highly interactive workshop so expect lots of discussion and sharing of best practice, you will participate in a mock investigation where you decide whether there is a case to answer, and we will explore practical issues that arise during the process and options for managing these.

Who should attend this workshop?

This workshop is aimed at SME business owners and line manager, who need to upskill their team's know-how and skills to delegate more HR activities. Also, individuals that have HR responsibilities in addition to other duties such as Finance, Office Management, Facilities, Health and Safety.

Also, someone looking to update their HR industry knowledge, having secured HR qualifications, or have primarily worked in HR.

Please note that this workshop is open to trading SMEs based in Derby, Derbyshire, Nottingham and Nottinghamshire. Businesses located outside of this area will be unable to attend and instead directed to alternative support.

What will we cover?

  • Describe why having disciplinary and grievance procedures are essential for your business.
  • Organisational and procedural aspects of a disciplinary hearing.
  • The difference between (mis)conduct and capability.
  • The ACAS Code of Practice on Disciplinary and Grievance, what is it and how does it apply?
  • How to produce an investigation plan and manage the investigation process.
  • How to produce an investigation report, what to include and what not to.
  • How to review the facts of a case and draw conclusions based on the balance of probabilities.
  • Chairing a disciplinary hearing and managing witnesses.
  • Following up a disciplinary hearing and managing appeals.
  • Records and data protection as part of the disciplinary process.

Practical skill based exercises

  • A mock investigation where you will decide the outcome based on the evidence.
  • Listening and questioning skills to use during an investigation.

Tricky Issues

  • Dealing with matters informally versus how to decide when an investigation is necessary.
  • The role of suspension and investigations, when to suspend and when not to.
  • What to do if the employee is signed off sick during the disciplinary process.
  • What to do when an employee fails to attend the disciplinary hearing.
  • Employee representatives and trade union representatives, their role
  • in the process and how to manage this.
  • Dealing with difficult witnesses and uncooperative employees.
  • Penalties and how long these remain on record.
  • Hybrid working and managing disciplinary processes remotely.

After attending this Workshop, you will:

  • Understand what happens during an investigation and disciplinary hearing.
  • Be aware of the different sanctions available during a disciplinary process.
  • Understand what constitutes unfair dismissal.
  • A plan to implement back in your business so disciplinary issues are managed smoothly and in line with best practice.
  • Sharing best practice HR and HR experiences from within your industry / workplace.

This is an interactive, action planning workshop which will be delivered in-person. Who’ll be presenting this workshop?

Sarah Loates is a chartered HR professional with over 20 years HR experience. During this time, she has provided HR advice and support to a wide range of industry types and sectors, ranging from private and family-owned businesses whilst at Cooper Parry, to the leadership level of multinational corporations such as E.ON. Sarah’s areas of expertise include employee relations, employment law and talent management.

Sarah is the founder of Loates HR Consultancy and Loates HR Training. Established in 2011, the Loates HR team is based at the scenic and historic world heritage site of Darley Abbey Mills, Derby. And over its ten years in business established a reputation for pragmatic and professional HR for East Midlands SMEs.
